Terms of Service

Acceptance

By creating an account or using FanPoolHQ you agree to these Terms and to our Privacy Policy. When you sign up you are asked to accept them explicitly. If you do not agree, do not use the service.

Eligibility

You must be at least 14 years old to create an account. If you are under the age of majority in your province or territory, you need the permission of a parent or guardian.

The service

FanPoolHQ is free and provided “as is”. We may change, suspend or discontinue any part of it at any time. Some features are labelled beta: they may be incomplete or change without notice.

Your account

Keep your password confidential and your information accurate. You are responsible for activity on your account. Tell us promptly if you believe it has been compromised.

Acceptable use

You agree not to:

• harass, threaten or bully anyone, or post hateful or discriminatory content;
• send spam or unsolicited promotions;
• impersonate another person or misrepresent your affiliation;
• post illegal content or use the service for an illegal purpose;
• scrape or bulk-collect data from the service, or circumvent rate limits, access controls or other technical limits;
• upload content you do not have the rights to, including NHL or team logos you do not own.

Your content

You keep ownership of what you post (team names, logos, forum posts, messages and similar content). You grant FanPoolHQ a non-exclusive, worldwide, royalty-free licence to host, display and reproduce it as needed to operate the service. We may remove content that breaks these Terms, and suspend accounts that do.

Reporting content and takedown requests

Send copyright notices, defamation complaints and any other complaint about content to support@fanpoolhq.com. Identify the content and explain the problem. We review notices and act promptly.

Commissioners and leagues

A league's commissioner controls its settings, rosters, approvals and membership. Disputes between league members, including with the commissioner, are for the members to resolve. We may help where something is technically wrong, but we do not arbitrate league decisions.

No real money

FanPoolHQ does not collect, hold or pay out any money, and no feature involves entry fees or prizes. Any side arrangement between league members (entry fees, prizes or otherwise) is solely between them, must comply with applicable law, and FanPoolHQ is not a party to it.

Data accuracy

Statistics, injury, schedule and contract data come from third parties and may be wrong, incomplete or delayed. We are not liable for decisions made on the basis of that data.

Third-party imports (ESPN / Yahoo)

If you import a league from ESPN or Yahoo, you are responsible for having the right to import that data and for complying with those platforms’ terms. Any credentials you provide are used only to perform the import and are deleted afterwards.

Third-party services and advertising

The service relies on third-party providers and may show advertising and links to other sites. We are not responsible for third-party sites or services, which have their own terms and policies.

Donations

Donations are voluntary. They are not tax-deductible and do not buy any service, feature or advantage.

Intellectual property and non-affiliation

FanPoolHQ is an independent product. It is not affiliated with the NHL or the NHLPA. Neither the National Hockey League nor the NHL Players’ Association endorses or sponsors FanPoolHQ. Player names and statistics are used for fantasy game purposes. NHL, team names and logos, and other marks belong to their respective owners. The FanPoolHQ software, design and brand belong to us.

Disclaimer of warranties

To the extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, availability or accuracy.

Limitation of liability

To the extent permitted by law, FanPoolHQ and its operator are not liable for indirect, incidental or consequential damages, or for loss of data, arising from your use of the free service. Nothing in these Terms limits rights that consumers in Québec cannot waive under the Consumer Protection Act, or any other right that cannot be excluded by law.

Termination

You can delete your account at any time in Settings. We may suspend or close an account that breaches these Terms.

Changes to these Terms

We may update these Terms. We will notify you of changes, and for material changes we will ask you to accept the new version before you continue using the service.

Governing law

These Terms are governed by the laws of Québec and the federal laws of Canada applicable there. Disputes are submitted to the courts of the judicial district of Montréal, subject to any right you have as a consumer to bring proceedings in your own district.

Language

The parties have required that these Terms be drawn up in both French and English. Les parties ont exigé que ces conditions soient rédigées en français et en anglais.
